Legal Question in Family Law in California

Legality of Confidential Marriage Licenses

When my Husband and I marrried, we were married using a Confidential Marriage License. I do not recall that we ever filed it with the Court, only signed it at the Ceremony. Does the Person who married us file it, or are we not legally married? We are actually seperated and planning to divorce, is it necessary? We have split our property and there are no children of the marriage. I have never taken his name or filed my taxes with him. I am unclear as to which direction to go in? Thank you.

In a general sense, the person who married you completes and files the document for you. Even if the document were not completed and filed, you would be treated as though you are legally married by the family law court.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
