Legal Question in Family Law in California

Legally changing my son's last name.

I would like info on changing my son's last name to mine. He is living with his mother, is 15 years old, and just came back into my life. I was in and out of his life from infancy, due to my personal issues, and am now trying to be a part of his life. He and his mother are okay with that. He is my only child, my only son.

If there is a paternity or dissolution action which finds that you are the father, the name may be changed in that proceeding. If you have not be ajudicated that Father, that will need to be done. The biggest hurdle is what the Mother and Child will want to do concerning the name change. The court will change the name if it is in the best interest of the child, which may require consent of your child and the Mother. Good Luck, Pat McCrary
