Legal Question in Family Law in California

i am legally divorced and have sole legal and physical custody of my child. but as i was trying to get a visa to go to india for my daughter. i was asked to get a letter signed from the consulate. so my question is that if i have the custody of my child why would i need his approval? can anyone help please...

Federal law requires this to reduce the possibility of a parent taking a child to another country, and interfere with the other parents rights. In you case you if father will not agree to the issuing of a passport ot your child, you wil have to get a court order that you can obtain the passport and travel outside of the US.
