First the rule about paying spousal support for a period of time equal to 1/2 the length of the marriage does not exist. The law states that it is the goal to have the supported spouse able to be self supporting in a period of time equal to 1/2 the length of the marriage. The 10 year rule requires a specific finding by the court that the supported spouse is able to be self supporting before spousal support can be terminated. The fact that you are 3 weeks short of the 10 year mark should have, at most only a minimal effect on the issue of spousal support. Other factors such as your work history and earning capacity will be more important. Consult with an attorney to fully review the facts and your options.
