Legal Question in Family Law in California

legally responsible

my grandughter who lives with me was caught shoplifting and the store is asking for payment under ca penal code 490.5. I am not her legal guardian, however she does live with me full time. Am I going to be held liable to the merchant for damages?

Re: legally responsible

Probably not. However, your granddaughter will have to deal with this. If the merchant is asking for the money directly, then you may be able to negotiate a lesser amount. If they have sent a collection agency to deal with the matter, then it is slightly easier to deal with because they have to validate the debt which is usually a bit cumbersome in shoplifting cases.

More improtantly, your daughter will have to address her criminal charges which are almost sure to follow.
