Legal Question in Family Law in California

Lesbian Couple Having a Baby Together

My partner and I are married in CA and plan on having a baby. We have a donor, but we are conceiving naturally instead of IVF. The donor will not have contact or be responsible for the child. We want my partners name to be on the birth certificate. Is that possible or will she have to adopt the child? Also to protect all of us, is there procedure (forms, written statements to sign) for the donor to yield his paternal rights?

Thank you for your help.

Re: Lesbian Couple Having a Baby Together

you should consult an adoption attorney because this area is quite in flux and complicated right now. First thing if you havent', i would suggest you become married or domestic partnered before the birth.

good luck

As always consult a qualified attorney in your area before proceeding.
