Legal Question in Family Law in California
Letter of Child Support Case Closing
I have a current child support order in San Diego County. I am the custodial parent and the non custodial parent was ordered to pay child support and arrears support (DCSS). Since the opening of the case back in 1998, I seldom received support checks do to the non custodial parent not working and her being in and out of institutions. Since October of 1998 the non custodial parent has not seen the child nor made an attempt. Today I received a ''Notice of intent to close case'' from DCSS and the reason it gave was-'' There is no longer an enforceable support order and arrears are less than $500.00, or the arrears are unenforceable under state law.'' My question is.. What exactly does that mean? We have not received anything else regarding this.
Thank you in advance

Re: Letter of Child Support Case Closing
It appears that the DCSS believes that child support can not be collected. You should contact them to find out why. Their number is 619-236-7600. You may then wish to talk to a private attorney about collection of the support as they do not seem to be very agressive. Do you know where Father is and whether he is working or otherwise has assets? Good Luck, Pat McCrary
