Legal Question in Family Law in California

Life Support

I was married for 20 years. I am told I have to support my ex for the rest of her life. Is their case law that says this? Can I go back to court and fight this to get it overturned? Help, Help

Re: Life Support

The lifetime support is not the complete story. The case of marriage of Gavron states that it is public policy that everyone become self supporting. If your ex-wife is capable of being employed then she should work toward becoming self supporting. Issues for the court to consider is her ability to become self supporting, the community standard and your ability to support her. If you are a high earner, she may never be able to support herself at the higher level (not necessarily equal to your income). Talk to an attorney who can look at your whole case. You may wish to file a motion have the court issue a "Gavron" warning, that she should work toward becoming self supporting. Paying for her education and rehabilitation into the market place may be an option. There are many variables, but lifetime support is the exception rather than the rule unless your ex cannot be rehabilitated into the workplace. Your duty to support her also terminates when she remarries. (You can always hope) Good Luck, Pat McCrary
