Legal Question in Family Law in California

is there a limit to how long my divorce should take?

I filed for divorce in July 2000 and by June 2001, me and my wife with lawyer representation had already aggreed on all issues. It was a matter of her lawyer typing up the final papers, getting our signatures, and getting it signed by the judge. I signed the final papers in September 2001 and my lawyer sent the papers back to my wife's lawyer. In January this year (2002) my lawyer sent a letter to her lawyer asking on status after not receiving a call back to his phone messages. My lawyer said that the only option is to go back to court but I have to give him more money for representation. Is there any other options I have than going back to court? also, Its almost two years since I started the divorce process, is this a normal amount of time to get the papers signed by the judge?

Normally the stipulation is prepared signed by the parties and the court within a few weeks. However, there is no limitation on the time get the court order signed. Obtain a copy of the reporter's transcript, assuming that the agreement was stated on the record.

It may be necessary to go to court to enforce the agreement. You should be able to get an order that either your ex-spouse or the attorney pay any attorney fees.
