Legal Question in Family Law in California
my name is Linda. I live with my husband of 30 years, I don't sleep in the same bed as he, we really don't live like husband and wife well at least not in the traditional aspect. He's always threating me he's going to throw me out if I don't pay him equal rent, or If he needs money for what ever he say's he's going to throw me out on the street. Now I am not employed and haven't been for quite some time, I have no income of any sorts coming in, have no vehicle to get around, no family living in this state that I can go stay with, I have constant chronic back pain every day that prevents me from getting a job. So can he just throw me out into the street legally?

No, your husband cannot throw you out of the family home. Court orders are required to deal with this issue. If you are peacefully cohabiting in the home, the court would allow you both to remain there until further orders have been reached on division of property. If your husband continues to be abusive and threatening, you could request from the court restraining orders for his removal from the house.
