Legal Question in Family Law in California

I did not list the biological father's name on my daughter's birth certifate. No one is listed but I have since married. Can I put my husband's name on her birth certificate in the father's space?

Does this mean he is legally her father?

It takes a court order to modify a birth certificate in the State of California. That court order only comes from a judge issued in a paternity case. I suggest you speak with a competent family law attorney who is thoroughly familiar with California's paternity laws to determine whether or not that is appropriate or feasible for you. Otherwise, you husband would have to adopt her, which again would give you the court order to modify the birth certificate.
