As long as there is no custody order in place, you can legally move and take the boys. If you move to another county, however, there is a four-month window in which he might be able to obtain an order that he be awarded custody and the children be returned to the county where you now live. Whether or not that would happen would depend on too many factors and circumstances to even begin to go into in an internet question and answer.
