Legal Question in Family Law in California

I live in California my children stay w my mother in Indiana im the legal parent the father is now trying to establish paternity and take custody in Indiana can i bring my children back home and fight from here or they stuck out there?

Is there an already existing custody case? If so, that court has continuing jurisdiction over the matter. If there is no existing case, Indiana has jurisdiction over your children if they have resided there for at least six months. That would be the appropriate place for a paternity/custody matter to be brought. Even if you went to Indiana and brought your children back home, it would require six months' residency in California before you could file custody here. It would best to discuss this matter with an attorney.
