Legal Question in Family Law in California
I live in California and am currently going through a divorce. Initially neither my husband or I had attorneys; then he told me he was going to have a consultation and would let me know if he wanted to secure the attorney or keep it between the two of us. I have yet to hear from him. Can he obtain an attorney and not make me aware of it either via a letter from court, his attorney, etc.?
1 Answer from Attorneys
It depends on what the status of the attorney is. If the attorney is advising him in the background under a limited scope representation, you may never know it. If the attorney files papers for him, the limited scope representation is supposed to be disclosed. If the attorney is going to appear in court for him, the attorney and he will have to file a substitution of attorney with the court and serve you with a copy.
