I live in California my ex-boyfriend and I do not have a legal custody agreement. Can I leave the state with my daughter

Yes, but if he is the legal father, e.g., listed on the birth certificate, acknowledged by both of you in a properly filed declaration of paternity, or there is a judgement in a paternity case, then he would have the right to get an order that you return the child to California, if he exercised that right within six months of you leaving.
