Legal Question in Family Law in California

I live in California. My husband and I have 2 children and I want to move out. I have not filed for separation or divorce yet because I cannot figure out which forms need to be filed right away and which can wait. Do I need to get some custody orders before I move out?

You do not need any orders before you move out. Parents who are focused on the good of the children can often go months or more without any orders. If your husband is going to be hostile and/or combative, however, you may need orders quickly. If you feel you have the time, I suggest you order a copy of How To Do Your Own Divorce in California from Nolo Press. It provides step-by-step instructions and forms. You can also get help with forms and procedures from the Legal Aid Society of Nor. Calif. or the self-help clinics at the superior court. Call 530-823-7560 for information on self-help services.
