Legal Question in Family Law in California

I currently live in California. My mother is homeless and has been for several years. She lives under a bridge in a really bad situation. She is a severe alcoholic and drug addict. She gets money from Social Security every month and makes enough for rent and food. What would I have to do to take control of her finances? She is willing to let me do it because she cannot handle it.

You can file for a power of attorney or a conservatorship over your mother. You should speak with a wills and trusts attorney to see if they would be able to draft one for you. Your mom to consent to that type of arrangement would need to be coherent and have the ability to consent to signing the paperwork.

If your mother's only source of income is social security benefits, you may be able to become the designated recipient of the social security benefits, with your mothers consent and be able to help her without a conservatorship or the need for a power of attorney. Check with the local social security office.
