Legal Question in Family Law in California
I live in California. When I got pregnant 3 years ago my then boyfriend told me he was going to go see his ill father and would be back in a couple of weeks. He never did go to his dad's and is now living in Oregon.
Since having been there he has been arrested ten times for assault, public intoxication, indecent exposure, assault on a police officer, malicious mischief, being under the influence of narcotics, possession and attempted possession of pot and meth (turned out to be a real peach). I have been in contact with his ex wife who he keeps in touch with and she tells me he is now homeless but won't come back to California because he doesn't want to pay child support or see "that damn kid". He is the classic definition of a deadbeat and I'm pretty sure it's illegal to flee the state to avoid child support payments. He has never met his daughter and I'm ok with that now.
In the mean time I have gone back to school and finished my BA and am getting ready to go to grad school. I'm going to be moving out of state and all my paperwork for childcare and family housing is asking for a judgement stating I'm the legal guardian, an order of termination of paternal rights, or a death certificate for her dad.
I called and explained the situation to the university but they still require some form of documentation but they don't know what. I left a message with their legal department and haven't heard back so now I'm wondering, what kind of a petition should I file here in Ca. to satisfy the legal requirements in Texas, when my daughter's father won't leave Oregon or acknowledge any of my attempts to get him to even call me to discuss it?
