Legal Question in Family Law in California

I live in california, my son mother and I have ended our relationship and now she does not allow me to see my son. She is also trying to get sole custody of my son, I just want to have joint custody so that I can be a part of my son' life, what can I do? Also I would like for my son to have my last name, but the mother says she will not allow it, what can I do?

If you are not married to your son's mother, you would have to file a paternity action to obtain custody and visitation orders. If you are married, you would do this with a petition for dissolution.
