Legal Question in Family Law in California
Hi, I live in SD,Ca. My question is...I've been separated from my husband since Dec. 31st 2011 and we tend to disagree regarding preschool's our daughter will go to this summer...is it illegal for him to record a phone conversation or a verbal face to face conversation without my consent? If our daughter is around does she count as another person making this public...if its outdoors or indoors...what does the law say is what I'd love to know.
Also, if my husband and I disagree as to what school we will enroll our daughter in for August...is it legal for him to put her in the school he wants the days he has her? He told me he would do that and that I. could put her in another school the days I have her...as messed up as that sounds...can he really do that without my consent? I don't want that for my daughter at all. He's an attorney and I'm afraid since he's very aware of the law and I'm not.

He needs to inform you that he is recording in order for the recording to be admissible.
He may put your child into a school where he is, when your child is with him and you put your child into a preschool where you are, when your child is with you.
