Legal Question in Family Law in California
We live in Sonoma County California. My sons ex girlfriend is due to give birth to his child in a few weeks. He was in jail for non violent, non drug related probation violation for most of the pregnancy and is now out. He has learned the ex gf has picked out a adoptive couple for the baby. He has not, and will not terminate his rights or "sign" anything despite being pressured by ex gf and now lawyer. The mom has not told the prospective parents or the lawyer that the dad does not agree and will seek custody of the baby at birth. They are both in their 30's. Question: We heard the "adoptive couple" will be at birth along with my son. They cant take the baby, Mom has no interest but will not want my son/us to have baby. She has no home and has been staying in motel paid for by couple she chose. What do we do? Can my son, the father, take the baby from the hospital? CPS wont get involved unless baby is abandoned. Can Mom take baby against my sons permission? To motel? He has nice home (mine) to live in and a job. Mom has nothing and has had two kids removed and adopted out by CPS already. How does my son get custody and what will happen at hospital? Due to Moms disconnect and attitude about entire thing, we have concerns about the safety of baby in her care or she will try to give him up behind my sons back. Thanks for any advice

You need a lawyer to get into court NOW on a paternity action and to stay any adoption proceedings. Only a good lawyer will get this put on hold until everything can properly be sorted out.
