I currently live in southern california, and have a custody case in sacramento county,

I need to file a modification of custody, because the other parent refuses me any contact with our child. Can I file this motion, with the court by mail, without having to file an Exparte in person?

Yes, you can file your court paperwork by mail. You might also consider hiring a legal service/court runner to do the filing in person for you. Sacramento County Superior Court is especially impacted by the budget right now. It's to your benefit to make sure you do the paperwork correctly and file properly. Your matter will be delayed further if you don't get it right from the beginning.

Ex partes are reserved for emergency circumstances only. In other words, there must be a risk of imminent, irreparable harm if the court does not take action. This is a very high threshold.
