Legal Question in Family Law in California

How long does a non custodial parent have to be absent before an abandonment case can be filed? The father of my child has been absent for a year and a half after a domestic violence case and restraining order with myself. He is not on the birth certificate and hasn't paid child support until recently, but it has been ordered for the past year and a half.

Generally the minimum time is a year, however if he has been paying support you will have a tough case.
