Legal Question in Family Law in California

how long do i have to wait until i get the final divorce ? i filled it last july 7,2010 with attorney, all the paper works are done already. the attorney said ,we will just wait until six months..i wait for almost 9 months already...is there something wrong or should i wait until i dont know...when i go to visit my attorney ,he is busy,when i talk to him , he says 2 weeks, after that, 3 weeks again, i dont know the answer...can i go to another attorney???

You can always go to another attorney. That can, however, be expensive, because even with most everything done, the new attorney will have to review everything and aprove it or revise things they don't approve of, before they will be willing to be responsible for any outcome of the case. In defense of lawyers generally, I should also say that solo and small firm attorneys sometimes get stuck were they have to do more than they have time for. So the matters with deadlines that will affect the results of the case are the ones that get worked on, and other clients have to wait until the rush passes or their matter becomes the one that must be worked on or bad things will happen. So I recommend at the very least sending your attorney a letter telling them you are dissatisfied and asking for a face to face meeting for them to explain what they have left to do for you and when it will be done. Tell them that if they do not give you this meeting and the follow through, you will hire another attorney. If that doesn't get results, then you truly should find another attorney.

You may want to determine what has been filed with the court, by seeing if the court has a website or a courthouse where you can view the file. You are going to want to know if papers were really filed, what was filed, whether your spouse has been served, and whether a response has been filed, or a default taken.
