There is no waiting period for filing a petition to be the guardian of a child. The difficulty is that when the child is in protective custody you cannot indicate to the court that the child lives with you which is a factor the court will consider in evaluating your home and ability to serve as a guardian. You may want to contact the agency and indicate whether they will place custody with you and then file. But there is waiting period.
