Legal Question in Family Law in California

Loss of Parental rights

If the father lost all parental rights to his child (for an abandoment case), does that also mean that he then doesnt have any responsibility to have to pay any child support for that child?

Re: Loss of Parental rights

The obligation for support can only be terminated by an adoption of the child. Otherwise the obligation for support continues. I would suggest that any order terminate an obligation for support will be ineffective because it is the right of the child to be supported. Good Luck, Pat McCrary

Re: Loss of Parental rights

If a father loses all parental rights, it does not necessarily mean that he also loses all parental responsibility. If the termination order does not deal with child support, it is possible that the father will still be responsible for paying child support even though he has lost all of his rights to the child.

In order to have his child support obligations extinguished, he may have to bring a modification order before the court. (Whether this needs to be done will also depend on whether the child was or will be adopted by another parent.)
