Legal Question in Family Law in California

if I make an agreement with my daughters' father in order to obtain his consent for their passports with that notarized agreement hold up in court?

If you both have legal custody why would it be against the law to get a passport for your child? Unless there are issues with possible kidnapping of the child, I don't see why it would be objectionable for the child to get a passport. You should just tell the father that the passport is part of any child's development to see the world and experience different cultures.
