RE: How To Make An Offer To Pay Arrears (They Lied To Us!)

This is in reference to my post on 2/15/03. Since we really can't afford to hire an attorney ($5000?) we decided to go in and try and make an offer. We had aprox $9000 on our credit cards to work with. First of all they refuse to talk to my husband with me present so he had to go it alone. They then said if we paid off the first two cases they would lower the garnishment from $1000 to $200, give us a printout of payments and once they rcvd our tax refund we could work a deal on the last case. Then they refused to take the cc so we went to the bank and got a cash advance came back and paid off the first two. We have separate reciepts for each case. We had planned on paying off the last case by April. Well as soon as they got their money they then turned around and said there was no guarentee that what we just paid would go to these cases!

Well they confirmed it yesterday, the money is going towards all three! How can they do this to us? We are trying so hard to get this paid and it seems like they just won't let us! We just handed over $2000 plus they will be getting an additional $4000 from our taxes. Now what do we do?

if you feel you were the victim of intentional misrepresentation and/or fraudulent inducement in entering the so called agreement to pay off some of your debt, and relied on the misrepresentations when making your $2000 payment, you would have a cause or causes of action against this company for sure. if you email me the specifics of your case and the "fraudulent agreement", i may be able to further assist you legally.
