Marriage anullment

I would like to know the guidelines for an anullment vs. a divorce in Calif. I have been married for 3 months.

There are Statutory requirements for obtaining an annulment and there must be a proper basis for seeking one. There are many different basis for which you may annul your marriage such as fraud, mental insanity, physical incapacity, bigamous marriage (legally married to someone else), . . . , however there must be sufficient facts supporting your contentions. To qualify for an annulment, you must meet specific statutory requirements. Being married a short period of time isn't sufficient to qualify. The statutory requirements are things like you find out you're actually married to a blood relative, you find out that you or your new spouse are not divorced from a previous mate & are still married....you get the picture.

The procedure for an annulment is the same as a divorce, including the 6 month waiting period, so there's little benefit.

If you're concerned about a church/religious annulment, you may still qualify even if you get a legal divorce. For the details on what your faith requires, you'll need to phone your religious institution.

There is no six month waiting period period for a

annulment (nullity). In addition, a person can

truefully say that they have never been married

because a annulment operates to wipe out the marriage. The paperwork for a divorce (dissolution) and a annulment are fairly similar.
