Legal Question in Family Law in California

marriage certificates

My fiance is buying a home. The mortgage company is requiring that he provide them with proof that his exwife is remarried and he is not obligated to pay alimony. He has no contact with his exwife and even if he did have contact shewould not comply with hisrequest. Is it possible for us to somehow locate and legally obtain a copy of her marriage certificate?

Re: marriage certificates

If you know the county in which she was married, you may be able to get a copy of the marriage certificate as a public record. However, if they obtained a confidential marriage, you will not be able to get a copy of the certificate. In that case your option is to change the mortgage company or to file a motion to determinate that spousal support has terminated. Good Luck, Pat McCrary

Reply: marriage certificates

A copy of the divorce Judgment should satisfy them as to whether or not he is obligated to pay spousal support.

Good luck to you!
