Legal Question in Family Law in California

marriage to father who pays ''family support''

I am engaged to a man who has children from a previous marriage of 12 yrs. He currently pays them ''family support'' vs spousal and child support-and he pays a significant amt. I have three questions:

1) is my income and property at risk by the ex-wife when we get married? Can she request more money based on my income?

2)She is currently obligated to go back to work in 3 yrs, by their agreement. I know she does not want to...what happens if she doesn't?

3)What is Family Support and what are it's risks/advantages?

Thank you for your advice.

Re: marriage to father who pays ''family support''

1. Your income is used only to determine the amount of income taxes he would pay. Your income is not added to his income to determine the amount of support he would pay.

2. What happens if she does not go back to work in three years would depend upon many factors, and the provisions of the agreement.

3. Family support is a combination of child support and spousal support. The advantage is that family support is deducted from his income and added to her income. Thereby reducing his taxable income.

To get a complete explanation of the situation you need to discuss the facts with an attorney.
