Legal Question in Family Law in California

Marriage

My husband took forever to sign the petition for my divorce, and I am now planning on remarrying another man (in the military) my first marriage took place in CA, and I was told my divorce won't be final for another 8 to 10 months. I've heard of a paper that my former husband could sign that would allow me to get married to my new fiance. Is there any truth to this?

Re: Marriage

It may be possible to speed things up by signing an "Agreement to Try at First Term" or whatever it is called in your jurisdiction. Consult with a local attorney.

Re: Marriage

Not to my knowledge. Under GA law if you are still married and remarry you are guilty of a crime. I don't do criminal, but I believe its a felony.

Re: Marriage

You do not state what state you currently reside in. Unless you reside in California for 6 continuous months before filing your petition, you cannot get divorced here. Only your husband can get divorced here if he resided here 6 months before filing. You cannot force him to divorce you. I suppose you could offer him something of value to divorce you, like he won't have to pay you spousal support. If your husband agrees, you could get the divorce decree probably within 60 days, or maybe even a shorter time if you find a judge who will believe your circumstance is compelling.
