Legal Question in Family Law in California

Marriage involving real estate

If my spouse leaves the country for more than 5 years without any contact or return to the states during this time and we had purchased a home together in California prior to the spouse leaving, will I be able to sell the home without his authorization? If so, will the spouse receive any of the proceeds? There has been no filing of separation or divorce. Thank you.

If you are both on title to the real property, you will need two signatures or a court order.
