Legal Question in Family Law in California
My First Marriage, His Third
If I marry a man who has a child from a previous marriage, can she sue me, garnish my wages, etc (basically take any of my money) for child support for any reason? For example, if he gets laid off?

Your wages would not be subject to child support payments, however, any jointly held property would be liable for child support. The court could order him to pay support based on his ability to earn and not his current income.

Your separate assetts not in question, however, his payments based on ability to earn not necessarily his actual earnings. See counsel if further concerns.
