Legal Question in Family Law in California

marriage

Have recently seperated from 4th marriage, nothing filed with courts yet. Have recently found out that the divorce filed from marriage #2 that was filed was never granted. Was under the assumption it was. Dumb! Anyway, marriage #1 and #3 were granted divorces. Question is was marriage #3 ever legal and what do I do about marriage #4. Is it a legal marriage and what to do to file for divorce or need to? I am terrified of what trouble I could be in for this. There is a child from marriage #4 in my care. Joint property? Please help!

First, relax. If you honestly did not know you were still married to #2 you committed no crime and are not in trouble. First, you need an attorney to complete the #2 divorce and then take it from there.

Marriages 3 and 4 are voidable. You will need to have a judgment entered in no. 2 nunc pro tunc, meaning effective on a particular date. The date should be before you married the third time. That will make #3 valid. Assuming you got a real divorce in #3, number 4 would also be valid.
