Legal Question in Family Law in California
Marriage, Seperation, Child Support
I am 6 mo. pregnant and recently seperated from my husband. He moved out of our house. He was making the living enviroment for myself and unborn child unbearable. He has brought into question the paternity of the child. I am on his medical insurance which I need to deliver the baby. His is paying the rent/bills, but still managing (with the help of his mother) to make it an uncomfortable/stressful living situation. What are my rights? When should I file for divorce/separation? How soon can I recieve child support benefits? Once the child is born and he is not paying the rent anymore, I will be moving with my family to live rent/bill free.....this is in Colorado. Can I move with the child? What are the consequences of moving out of state? Do I file for divorce/child supporte before or after I move?

Re: Marriage, Seperation, Child Support
You should file immediately and there will be an automatic restraining order to restrain him from canceling the insurance. You can receive child support immediately when the child is born and you can receive spousal support immediately. Good Luck, Pat McCrary
