No marriage-Custody battle-Both 18 years old
My exboyfriend (the father) raped a friend of mine, ''Sue'' a few months ago. She didn't file charges, but I have the document saying he did it. He is a constant smoker and an alcoholic at 18. He barely graduated h.s. and lives with 5 friends who party all the time. He's not working or going to college. I am 18, going to school next semester and living at home with my parents for the support. I also have a part time job which i will be starting again in January. I have a baby due in 3 weeks. I want him to have no part in her life. I am scared for him to be around her without me or my parents there supervising. He has threatened to hit me and raised his fist to me many times. He has a horrible temper and frightens me. He knows about her and refuses to give me any personal info about him for her insurance, even though he says he wants to be responsible. People are telling me its not worth the pain and time and to put father unknown on the birth certificate. I need to know the consequences of this and all the other options I have. I live in L.A. county

If he is in fact the father it would be a huge mistake not to list him as father on the birth certificate because he is obligated to support the child by law. He is 18 at this time, however he would have to legally support the child until the child reaches 18. You need to go to the Los Angeles County District Attorney and open up a case for the DA to get child support for you from the Father once the child is born. I would hire a private attorney on the issue of child custody and visitation once the baby is born. I am located and very familiar with the laws in Los Angeles County.
