Legal Question in Family Law in California
Marriage?with husband gone over 1 year!
Hi, I am 21 years old, and at the age of 19, I ran away and got married in Las Vegas, Nevada. I lived with my ''husband'' for only a short while. We revealed that I had gotten pregnant 4 months after we had gotten married. He left me when I was 2 months pregnant and I left a week later to Southern California, where I currently live with my daughter. My baby's ''father'' my ''husband'' has never seen my little one. He has never paid one dime to support her, and I have not lived with him, nor seen him, or talked to him for a year now. I do not want this attachment with him any longer, but to get a divorce I need him to sign papers, but how, I don't know where he lives, or where he lives. Does anyone have any advice about how to get this marriage off of my back. I want it over with so I can finally move on. He has a child with another woman that was just born.

Your husband does not have to sign any papers in order for you to get a divorce. even if you don't know his current address, there are ways to give him notice of the proceedings. If I can be of assistance, please feel free to call. Regards, Damian Nolan.

Your husband can be served by publication if he cannot be found after reasonable efforts to locate him. You would need to check with the DMV, voter registration and his family and friends. Then you would have to present a request for an order to serve by publication to the court and get a court order.
