Legal Question in Family Law in California

married with 1 child

I need help with knowing which forms or packet I need to complete my divorce. There has been no response from the other party. I also wanted to know what is the difference between joint, physical custody. And should I file default?

If the other side has not responded and the 30 days have past, then you probably want to look into filing a default. Knowing which forms to use and the requirements for a default can be confusing. I would recommend that you get an attorney to help you. Today many attorneys are offering "Bundled" services where they assist you in preparing all the forms and understanding the law, but you still represent yourself. Some clients like this type of service because it saves them A LOT of money. Bundled services works great in a default type of case, I normally would not recommend it if the case is going to be contested.

I have offered bundled services in the past and the relationship with the client has worked out well so I am willing to do it again. If you think you might be interested feel free to give me a call, I would be happy to discuss your situation with you.

I suggest that you go to the Family Law Facilitator Office at the court house. They will assist you in completing the necessary forms at no charge.
