Legal Question in Family Law in California

Which way should I go?

I am married with 4 children ages 16 to 19. Everything was going well until my husband left for the US. I met an old friend and things got out of control, I had an illicit relationship with this guy who is an american citizen. We have been in a relationship since 2001 without the knowledge of my family. My husband has a religious visa. He is not a U.S. citizen neither am I.

My boyfriend wants to marry me and help me get my children and myself to go to the U.S.

My husband and I had a falling out because of my coldness toward him.

Is it possible for him to grant me a divorce even if we are not married in the U.S. only in the Philippines?

I would love so much to marry my boyfriend but I am at a lost to what to do.

My husband is also trying to get our children to go to the U.S. I don't have the heart and guts to break my infidelity to my husband and children. I also do not want to jeopardize the chance of my children to go to the U.S.

What or which way should I go? I am so torn and at a lost. Could my boyfriend petition me without me being divorced (no divorce here)or having my marriage annulled? What is the best thing to do?

Thank you so much.

Yes, you can have the marriage declared a nullity even if he is in the US and the marriage is celebrated in the Philippines.
