Legal Question in Family Law in California
I’m married to a U.S. Citizen we have a daughter, I’m not legal. We had a verbal agreement that
we were going to do 50/50 time with my daughter and she broke our agreement but it didn’t matter
to me I still was seen my daughter, we agree to enroll my daughter in preschool half of the way to
her house and half of the way to my house but she broke our agreement again but as long as my
daughter was getting her education it didn’t mater to me. We recently got in a argument because I
wanted to open an saving account for daughter and asked her for the social and birth certificate she
wanted to came along I told her yes but she was going to ask permission at her work which she never
did I ask her again and she said that she needed to came along a said no that I was going to put my
daughter only. Its been two weeks and she hasn’t let me see my daughter. I called her and she dose
answer but wont talk I can hear voices of my daughter and her little sister. My question is can I do
something about it with getting in trouble with the law because im not legal..

Your rights in Family Court as father can be enforced without getting in trouble with immigration authorities. The immigration probably won't know about you unless someone complained or you happened to be in wrong place at wrong time. In family court, immigration status is not asked or relevant.
