Legal Question in Family Law in California

got married in December, and now my husbands mistress is saying she is pregnant with his child. She found out March 13th that she was pregnant, 2 weeks later she went to the dr and found outhese she was 8 weeks. My husband has gone back and fourth talking to her and not talking to her. In January she decided to run away to the valley with a coworker since my husband stopped talking to her. Now she is saying my husband is her babys dad. He is agreeing that he is the father. Is there any way I can have a court order paternity test to be sure if it is his or not. I am just trying to protect my husband if this is a false accusation. Please help.

I have to say, I can't quite decide if you are the most understanding and supportive new bride ever, or just crazy. To answer your question, though, the answer is "no." Only the mother or expectant mother of a child, or the alleged father (or certain government agencies in child neglect or abuse cases) can file a court action to have the paternity of the child determined. So only your husband or the mother could initiate such a case.
