Legal Question in Family Law in California

not married what can I do?

Not sure if this is the right forum for this question, but I think it kinda goes here.

My girlfriend and I are not married and things are not going well between us. together we have bought a house, condo and a couple of cars. What kind of actions can I take as to not to loose everthing i.e. get it to where everything we bought together gets split right down the middle.

Oh I might mention that she has 2 kids living here as well.

I would like all the help I can get, also if this is not the right fourm then please direct me to the right one.

Thanks

Dear Inquirer:

Nothing herein shall create an attorney-client relationship, unless a written retainer agreement is executed by the attorney and client. This communication contains general information only. Nothing herein shall constitute an attorney-client communication nor legal advice. There likely are deadlines and time-limits associated with your case; you should contact an attorney of your choice for legal advice specific to your personal situation, at once.

If you haven't already done so, please visit my

The site contains quite a bit of general information about California Family Law, Tenants' Rights, and Juvenile Dependencies, as well as information about me (education, experience, et cetera) and my office (location, hours, fees, policies).

NOW, IN RESPONSE TO YOUR INQUIRY --

The facts that you have provided are not clear

enough and/or complete enough to provide a

definitive answer to you inquiry. How long have you been together? What is your relationship, if any, to/with the kids. Basically, you probably each will have rights as if you were informal business partners. Unlike for a married couple, title of/on assets and obligations will be important. Also, either of you may be eligible to bring a Marvin action ("palimony") against the other, although such cases are very difficult to win. Too bad you didn't enter into a Cohabitation Agreement before you started commingling your finances. Hopefully, you will be able to enter into a written settlement/distribution agreement now, before things get really ugly.

Thanks for sharing your interesting inquiry, and good luck with your case.

You will need to bring what is called a partition action--it is a little more complicated than a divorce, but it will essentially cause all the assets to be split 50/50
