Legal Question in Family Law in California

Just married - husbands ex wife wants MY money

I just married a man who has 2 children by a prior marriage. No current support order is in place although he pays support twice a month ($800) though he is making only $3K a mo. plus private school costs and half of all activities and medical. His ex now says she will take him to court for after school care costs at the rprivate school since I make a good deal of money and WE can afford it. Can this happen?

It sounds like he might be paying too much as it is. I'd let her take him to court. The courts don't usually take into consideration the new spouse's income unless the ex isn't paying anything, or is paying very little.

New spouse income is considered only as to the amount of taxes paid. There may be some unusual circumstances under which the new spouse income could be considered in making a support order.
