Legal Question in Family Law in California

Married, on SSDI, need to divorce.

Hello and thank you for taking the time to address this. I am on SSDI (1,509.00), married close to 5 years and need a divorce. Am I still entitled to alimony or does the SSDI cause a forfeit? No children are involved. Who is entitled to our house? If I separate, do I have to leave the premises or him? (house in his name due to my bad credit, or so he told me) Any help greatly appreciated. Thank you.

Alimony is based on two factors, you need and his ability to pay. Standard of living is factored into need. The length of time that support is payable will depend upon the facts in your case. The time of one half of the length of the marriage is a goal and is not a hard and fast rule.
