Legal Question in Family Law in California

I was married in Vegas, NV in nov 1998 and currently live in CA.

the "husband" was jailed not long after we were married and he was deported back to his country oversea in 1999 and havent heard from him since.

1. do i file in NV or CA?

2. am I qualify for annulment?

3. how long do i need to wait before i get re-marry?

4. can i do it myself or do i need a lawyer?

You can file a petition for dissolution in California. Obtaining an annulment is difficult as there are few circumstances that will support a petition for annulment. For a dissolution of marriage you will have to serve him by publication. The marriage can be dissolved the earliest 6 months after the service of the petition for dissolution is served on him. In this case after the final publication date when service is complete. You should consult with an attorney regarding the possibility of obtaining an annulment on the grounds of fraud.
