Legal Question in Family Law in California
I married my wife in Virginia in 2000. In June of 2002 we moved to California, she returned to Virginia 3 months later. We both no longer want to remained married and have no children, houses, property, or debt to split. I have tried to contact her repeatedly to initiate divorce preceedings. Is there a low cost, simple way I can dissolve this marriage? Is there a way to do it with minimal effort on her part as I am having a hard time getting her to cooperate. She seems indifferent and doesn't return phone calls, etc. Thank you for your attention.

An uncontested, no asset, no children divorce is very very easy to do in California, and since you have resided here for the last six months or more, California has jurisdiction over the matter, no matter where you wife is. I recommend you pick up How to Do Your Own Divorce in California (Nolo Press). It has clear, easy to follow, step by step instructions, and all the forms. All she will have to do is accept some papers by mail and sign and send back one page acknowledging she got them. The rest you can take care of here. And if she refuses even to cooperate that much, there are still pretty simple ways to get her served, and once that happens, a default divorce is pretty easy.
