Legal Question in Family Law in California
I have been married 4 years, we both had good jobs, and I was laid off in october and collecting unemployment. I have owned the house we presently live in for 20 years and owe $70K but worth around $600K - $650K. - the title is in a trust fund and all my assets. He owns a house that is underwarter Paid $250K and is valued at $150K rents at less than half the mortgage, and has around $35-40K credit card debt, car payment of $500 per month, plus student loans. I am debt free. If something happens to me am I responsible for all his debt?
We have never had joint checking accounts, he has not paid anything towards my mortgage, and lives here pretty much rent free, pays for a few minor bills. I am feeling financially strapped and he says he can not help me. He makes around $100K per year. I am collecting unemployment.

Whether you are responsible for his debts, to the creditor, is questionable. If it was a debt incurred during the marriage, it is a community debt and you may be responsible to him to pay one half of that debt. You cannot make him pay any of the bills, short of filing for a dissolution of the marriage. You should have a consultation with a family law attorney before making any decisions.
