If you have an existing case you need to terminate the status of your marriage. Your wife's refusal is not grounds to deny the termination of the status of your marriage. The law will not keep two people married if one of them does not want to be married anymore. If you have other issues, you will have to file a motion to bifurcate to terminate status, and reserved jurisdiction over the other issues. You may qualify for a divorce now, if you meet the jurisdictional prerequisites.
