Legal Question in Family Law in California

What is the Maximum child support?

I'm asking this for my son who is 30 yrs..His girl freind(never married) has been nagging at him for more child support. She says she can take him to court and get half of what he makes at his job. They have a court order on how much he pays each month and now it's starting to come out of his paycheck through the D.A. office. This amount that he pays was figured with a program called DISOMASTER(MAY NOT BE SPELLED CORRECTLY).It figured his pay and her pay monthly and he's been paying it faithfully. Is their a Maximum amount that she can ask for?He also pays for half of the day care bills. They both work full-time jobs, but we don't understand why he needs to pay her more money or if she can keep taking him to court for and keep asking for more money. He is paying apprx. $615.00 a month this includes $175.00 for day care services. She is also threating not to let him see his 4 yr. old son if he does not pay her any more money.

Thank You for your help

Re: What is the Maximum child support?

The amount of child support is dependent upon the amount of gross income each parent has, the number of children, time of visitation, and some other factors that have some effect upon the final amount.

The 50% she is refering to is the maximum amount that can be with held from his pay check for child support. This amount can be increased if there is a special court order.

Child support and visitation are separate issues. If mom stops visitation she can be taken to court contempt. He should continue to pay the court ordered support. He should pay bony by check and keep every check for essentially the remainder of her life. She may at some time in the future claim that she did not receive all of her child support payments. The burden will then fall on him to prove that they have been made. There is no time limit on her claim that support was not paid.
